A taxpayer may file a petition with the Value Adjustment Board for the following reasons:
  1. The taxpayer objects to the Property Appraiser's value assessment of the taxpayer's real or personal property.
  2. The taxpayer's application for any of the following exemptions or special use classifications is denied:
    1. homestead exemption
    2. any other tax exemption as provided by Chapter 196, Florida Statutes or
    3. any special use classification as provided by Chapter 193, Florida Statutes.

INSTRUCTIONS FOR FILING A PETITION 

Select “File a New Petition” to begin the online filing process.    Complete the appropriate online petition and click ‘submit’. 

PETITIONS ARE NOT CONSIDERED COMPLETE UNLESS ACCOMPANIED BY A PAYMENT.

A non-refundable filing fee of $15.00 per single parcel is required, payable by Master Card, Visa, American Express, or Discover  credit card payments only.  A credit card convenience fee will be added to your charge (see below).

CONTIGUOUS OR MULTIPLE PARCELS

You have the option to file online separate petitions for contiguous undeveloped parcels or multiple parcels.  A $15.00 filing fee is required for each single petition.

To file a single joint petition for contiguous undeveloped parcels or multiple parcels, contact the Property Appraiser’s Office at (772)226-1506.  A $15.00 filing fee is required for the first parcel, with an additional $5.00 for each consecutive parcel.   Additional filing instructions are available at:  http://www.clerk.indian-river.org/index.cfm?method=ClerkToBoard

 LATE-FILED PETITIONS

Late-filed petitions  are those filed after the filing deadline of the 25th day following the mailing of the TRIM notice and will not be scheduled for a hearing.  Late-filed petitions must be accompanied by a written explanation showing good cause or extraordinary circumstances for the delay in filing.  The Petition will be submitted for a good cause review.  If your petition is received without the explanation, you will receive a “Clerk’s Notice” stating that your petition is incomplete and subject to not being processed.

 NOTES

The petition must be signed by the owner, filed by a licensed agent, or accompanied by written authorization from the owner.

You are required to provide a valid e-mail address to electronically submit a petition online.  Once you have submitted your petition, you will be provided with a transaction number and password, with which you can track the status of your petition.

Paying your property taxes if you file a petition with the VAB?

Pursuant to HB 281, effective July 2011, if you have filed a petition challenging the assessed value of your property, you must pay all of the non-ad valorem assessments and pay at least 75% of the ad valorem taxes, less the discount, if applicable, before the taxes become delinquent. 

If you have filed a petition challenging the denial of an exemption or classification, you must pay all of the non-ad valorem assessments and the amount of the tax which the taxpayer admits in good faith to owe, less the applicable discount, before the taxes become delinquent.  If the VAB determines that the amount of the tax paid is grossly disproportionate to the amount of the tax found to be due, the tax collector must collect a penalty of 10% of the deficiency per year from the date the taxes became delinquent. 

If the petitioner fails to pay their taxes before they become delinquent on April 1 of the tax year, the VAB must deny their petition by April 20th of the tax year. 

If the VAB determines that the petitioner owes ad valorem taxes in excess of the amount paid, the unpaid amount accrues interest at the rate of 12% per year from the date the taxes became delinquent until the unpaid amount is paid.  If the VAB determines that a refund is due, the overpaid amount accrues interest at the rate of 12% per year from the date the taxes became delinquent until the refund is paid.  Interest does not accrue on amounts paid in excess of 100% of the current taxes due on the tax notice.
